Transfer of Tenancy

Land Code Ch. 12, §§ 34–37

For robots

What does it mean?

Transfer means the lease is transferred to a close relative — partner, spouse, child, or parent. It normally requires the landlord's approval, but the Rent Tribunal can grant permission if the landlord refuses without valid reason.

Common situations: partner wanting to take over after separation, children who've lived long in parents' apartment, or surviving family wanting to stay after a death.

Key Points

  • Lease is transferred to a close relative
  • Requires landlord approval
  • Rent Tribunal can authorize if landlord refuses
  • Partners, children, and parents have strongest rights
  • Person must have lived in the apartment for a significant period

Practical Tip

Apply in writing to the landlord. If refused, contact the Rent Tribunal. Gather evidence the person has lived in the apartment — registration, mail, witnesses.

Legal Basis: Land Code Ch. 12, §§ 34–37
